Terms of Service

These terms govern your use of EventOS, operated by TrailBlaze Limited, a New Zealand company. By creating an account or using the service you agree to these terms.

1. Definitions

  • "EventOS", "we", "us" means TrailBlaze Limited.
  • "You" means the person or organisation using the service.
  • "Service" means the EventOS web and mobile applications.
  • "Organisation" means a tenant on the service.
  • "Volunteer Data" means personal information about volunteers that organisations collect through the service.

2. Your account

You must be at least 16 years old to create an account. You are responsible for keeping your password secure, for activity under your account, and for the accuracy of the information you give us. You can invite other people to your organisation; you remain responsible for their actions on your organisation's behalf.

3. Your organisation's data

You retain ownership of all data you put into the service. For volunteer data, you are the data controller and EventOSis the processor. You must have a lawful basis to collect each volunteer's data, give volunteers a clear notice of how you will use it, and respond to volunteer requests for access, correction, or deletion.

4. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose.
  • Collect data from people without a lawful basis.
  • Send spam or unsolicited marketing through the service.
  • Attempt to access another organisation's data or circumvent rate limits.
  • Reverse engineer or copy the service.
  • Resell or sublicense the service without our written permission.
  • Upload malware, illegal content, or content that infringes someone else's rights.
  • Use the service to harass, threaten, or harm anyone.

We may suspend or terminate your account if you break these rules, with notice proportionate to the severity.

5. Beta period and free use

EventOSis currently in beta. During the beta the service is provided free of charge, features may change or break, and we may end the beta on 30 days' notice. Beta users will get founder pricing when paid plans launch.

6. Paid plans

Once paid plans are active, they are charged in advance, monthly or annually, in the currency you select. Payment is handled by Stripe. You can cancel at any time; cancellation takes effect at the end of your current billing period. We do not refund part-period charges except where required by law. We may change pricing on 30 days' notice; changes take effect at your next renewal.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may take the platform offline for maintenance or to deal with security incidents.

8. Our intellectual property

The EventOS platform, brand, code, design, and documentation are our property. These terms do not give you any right to use our trademarks or logo without our written permission. You may use our brand to truthfully describe that you use EventOS.

9. Feedback

If you give us feedback, suggestions, or ideas we may use them freely without compensation. We will not name you or your organisation publicly without your permission.

10. Termination

You may close your account at any time using the "Delete account" option in settings. We will delete your data within 30 days, except where we are legally required to keep it (billing records). We may terminate your account for breach of these terms or if we discontinue the service; we will give at least 60 days' notice in the latter case and a way to export your data.

11. Warranties and disclaimers

We provide the service "as is" and "as available". To the maximum extent permitted by law we disclaim all implied warranties. If you use the service for business purposes the Consumer Guarantees Act 1993 does not apply. If you use the service as a consumer, nothing in these terms limits your rights under the Consumer Guarantees Act, the Fair Trading Act, or any other law that cannot be excluded.

12. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from these terms or your use of the service is limited to the total amount you paid us in the 12 months before the claim. For beta users on the free tier, our total liability is limited to NZD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. This section does not limit liability for fraud, wilful misconduct, or anything else that cannot be excluded by law.

13. Indemnity

You will indemnify us against any third-party claim arising from your breach of these terms, your collection or use of volunteer data in breach of law, or content you upload that infringes someone else's rights.

14. Changes to these terms

Material changes are notified by email at least 14 days before they take effect. If you do not agree to a material change you may close your account before it takes effect.

15. General

Governing law. These terms are governed by New Zealand law. The NZ courts have exclusive jurisdiction.

Notices. We will notify you by email at the address on your account. You can notify us at legal@eventos.nz.

Severability. If any part of these terms is found unenforceable, the rest stays in force.

Entire agreement. These terms, together with our Privacy Policy and (if applicable) the Data Processing Agreement, are the entire agreement between us.
